Terms of Service

1. Platform role (important)

Olwyz is an online intermediary / technology platform that enables users to publish classified listings and communicate with each other.

Olwyz is NOT a seller, buyer, broker, agent, or auctioneer of any listed item; a party to any transaction between users; a payment intermediary, escrow provider, or delivery/courier service; a guarantor of product quality, authenticity, legality, title, or fitness; or responsible for user conduct offline or outside the Platform.

Any sale, payment, delivery, refund, or dispute is solely between the buyer and seller, unless we expressly state otherwise in writing.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a contract under Indian law. You must provide accurate registration information and keep it updated.

3. User accounts

• One person must not maintain multiple accounts to deceive others.
• You are responsible for activity on your account and for keeping your login secure.
• We may suspend or terminate accounts that violate these Terms, applicable law, or community safety.

4. Listings & user content

You are solely responsible for content you post (photos, descriptions, prices, messages, reviews).

You represent that you have the right to sell or offer listed items; listings are accurate and not misleading; and items are lawful to sell and do not infringe third-party rights.

Prohibited content includes (without limitation): illegal goods, stolen property, counterfeit items, weapons where restricted, drugs, hazardous materials, hate speech, harassment, fraud, pyramid schemes, and content that violates any law.

You grant Olwyz a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute your content on the Platform for operating and promoting the Service.

5. Transactions between users

• Prices, payment method, meeting place, delivery, and handover are agreed directly between users.
• Olwyz does not process payments for user-to-user sales unless a separate feature explicitly says so.
• You assume all risks relating to offline meetings, transfers of money, and transfer of goods.
• Mark sold, offers, and reviews are platform tools only—they do not create a contract between Olwyz and any user.

6. Safety & anti-scam measures

We may provide tools such as chat, reporting, blocking, sale status, read-only locked chats, and moderation. These measures reduce risk but do not eliminate it and do not make Olwyz an insurer or guarantor of any transaction.

You agree to use common sense, verify items before payment, and report suspicious activity.

7. Premium / subscriptions

Optional paid features, if offered, will show price, duration, and renewal terms before purchase. Subscription fees are for Platform features only, not for any goods listed by users.

8. Intellectual property

Olwyz name, logo, app design, and software are our property or our licensors'. You may not copy, reverse engineer, or misuse the Platform.

9. Suspension & termination

We may remove listings, restrict features, or terminate accounts at our discretion for violations, legal risk, complaints, or harm to the community, with or without notice where permitted by law.

You may delete your account in-app. Provisions that by nature should survive (liability limits, indemnity, governing law) will survive termination.

10. Disclaimers

To the fullest extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that listings are accurate, that users will complete deals, or that the Service will be uninterrupted or error-free.

11. Limitation of liability

To the fullest extent permitted by applicable law, Olwyz and its owners, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses.

Our total aggregate liability for any claim arising from or relating to the Service shall not exceed the greater of (a) INR 1,000 or (b) the amount you paid to Olwyz for paid Platform features in the three (3) months before the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

12. Indemnity

You agree to indemnify, defend, and hold harmless Olwyz and its affiliates from any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Platform; your listings, messages, or conduct; your transactions with other users; or your violation of these Terms or any law or third-party rights.

13. Disputes between users

Disputes between buyers and sellers must be resolved directly between them. Olwyz may, but is not obliged to, assist by reviewing reports or preserving chat records. We are not a court, arbitrator, or ombudsman for user disputes.

14. Governing law & jurisdiction

These Terms are governed by the laws of India. Courts at Gurgaon, Haryana shall have exclusive jurisdiction, subject to applicable consumer protection laws that may provide otherwise.

15. Changes

We may modify these Terms at any time. Updated Terms will be posted in-app and on this website. Continued use after changes constitutes acceptance.
